These Terms & Conditions govern the use of the ecactivo.com website (hereinafter the "Site"), owned by Ecactivo Financiera S.A.S., an Ecuadorian company with Tax ID 1793284591001 and registered address at Av. República del Salvador N35-146 and Suecia, Quito, Ecuador. Accessing the Site implies the full and unconditional acceptance of these Terms & Conditions.
1. Purpose
The Site has an informational purpose only. It presents the real estate crowdlending platform that Ecactivo will launch during 2026 and allows interested users to voluntarily subscribe to the newsletter to receive information about the opening of the service.
2. No public offering
The information published on the Site does not constitute a public offering of securities, nor an investment recommendation, nor financial, tax or legal advice. Any investment decision, when the platform is operational, must be made after reviewing the specific documentation of each project and, when appropriate, after consulting with independent advisors.
3. Permitted use
The user undertakes to use the Site in accordance with Ecuadorian law, morality and good customs. It is forbidden to upload unlawful content, perform unauthorized accesses to systems, attempt to compromise the security of the Site or use the Site for activities related to money laundering or financing of terrorism.
4. Intellectual property
All contents of the Site (texts, trademarks, logos, images, code and databases) are owned by Ecactivo Financiera S.A.S. or its licensors and are protected by the Organic Law of the Popular and Solidarity Economy, the Organic Code of the Social Economy of Knowledge, Creativity and Innovation (COESC) and the applicable international treaties.
5. Third-party links
The Site may contain links to third-party pages. Ecactivo is not responsible for the content, privacy policies or business practices of such third parties. The inclusion of a link does not imply any endorsement.
6. Limitation of liability
Ecactivo does not guarantee the uninterrupted availability of the Site nor the absence of errors or viruses. To the maximum extent permitted by law, it shall not be liable for indirect damages, loss of profits or loss of opportunity arising from the use of the Site. Nothing in this section shall limit any liabilities that cannot be excluded by law.
7. Data protection
The processing of personal data is carried out in accordance with the Privacy Policy and the Ecuadorian Organic Law on the Protection of Personal Data. By subscribing to the newsletter, you give your free, specific and informed consent to receive commercial communications from Ecactivo.
8. Modifications
Ecactivo may amend these Terms & Conditions at any time by publishing the updated version on the Site with its effective date. Continued use of the Site after publication shall imply the acceptance of the new version.
9. Governing law and jurisdiction
These Terms & Conditions are governed by Ecuadorian law. Any dispute related to the Site shall be submitted to the competent judges of the city of Quito, Ecuador, with the parties expressly waiving any other jurisdiction that could apply to them.
