Privacy Policy
This Privacy Policy describes how Ecactivo Financiera S.A.S., with Tax ID 1793284591001 and registered address at Av. República del Salvador N35-146 and Suecia, Quito, Ecuador (hereinafter "Ecactivo", "we"), collects, uses and protects the personal data of the users of the ecactivo.com website, in compliance with the Ecuadorian Organic Law on the Protection of Personal Data (LOPDP) and its regulations.
1. Data controller
The controller responsible for the processing of your personal data is Ecactivo Financiera S.A.S. You can contact our Data Protection Officer at privacidad@ecactivo.com or by postal mail addressed to the address stated at the beginning of this document.
2. Data we collect
We collect the data you voluntarily provide when subscribing to the newsletter (full name and email address), data generated by your navigation (IP address, device type, pages visited, time on site) and data derived from the use of cookies and similar technologies, as detailed in our Cookie Policy.
3. Purposes of processing
We use your data to: (i) send you commercial information about Ecactivo and its upcoming launches; (ii) analyze aggregate visitor behaviour in order to improve the platform; (iii) respond to queries and requests; and (iv) comply with applicable legal obligations, including anti-money laundering obligations before UAFE when applicable.
4. Legal basis
We process your data on the basis of your free, specific and informed consent (art. 7 LOPDP), the execution of a pre-contractual relationship and the compliance with legal obligations applicable to the financial sector and to anti-money laundering.
5. Retention
We keep your data as long as your subscription remains active and, after unsubscribing, for an additional period of 5 years in order to address any claims and comply with the legal obligations imposed by tax and anti-money laundering regulations.
6. Recipients
We share your data only with technology providers acting as processors (transactional email, web analytics, hosting), all of them bound by contract with the clauses required by the LOPDP. We do not sell or transfer your data to third parties for their own commercial purposes.
7. International transfers
Some providers are located outside Ecuador, in countries with an adequate level of protection or with sufficient contractual safeguards (standard contractual clauses). You can request a copy of these safeguards at privacidad@ecactivo.com.
8. Your rights
You may exercise your rights of access, rectification, update, erasure, objection, portability, restriction of processing and not to be subject to automated decisions at any time, by writing to privacidad@ecactivo.com with a copy of your ID document. You may also file a complaint with the Ecuadorian Superintendency for the Protection of Personal Data.
9. Security
We apply technical and organizational measures appropriate to the risk, including encryption in transit (TLS 1.3), access control, pseudonymization, encrypted backups and periodic security audits performed by independent third parties.
10. Changes to this policy
We may update this Privacy Policy to reflect legal or operational changes. We will publish the current version on this page along with the date of the last update. If the changes materially affect the processing, we will notify you by email.
